These Terms of Service (“Terms”, “Terms of Service") govern your use of the web pages located at https://www.omnigpt.co. 

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and Privacy Policy.

If you do not agree with (or cannot comply with) these Terms, then you may not use the Service. Please let us know by emailing support@omnigpt.co so we can find a solution. These Terms apply to all visitors, users, and others who wish to access or use the Service.

Service Usage

• You must provide accurate and complete information when creating an account

• You are responsible for maintaining the security of your account

• You must notify us of any unauthorized access or security breaches

Content

Your content. You may provide input to the Services (“Input”), and receive output from the Services based on the Input (“Output”). Input and Output are collectively “Content.” You are responsible for Content, including ensuring that it does not violate any applicable law or these Terms. You represent and warrant that you have all rights, licenses, and permissions needed to provide Input to our Services.

Ownership of Content

As between you and OmniGPT, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output. We hereby assign to you all our right, title, and interest, if any, in and to Output.

Similarity of Content

Due to the nature of our Services and artificial intelligence generally, output may not be unique and other users may receive similar output from our Services. Our assignment above does not extend to other users’ output or any Third Party Output.

Accuracy

Artificial intelligence and machine learning are rapidly evolving fields of study. We are constantly working to improve our Services to make them more accurate, reliable, safe, and beneficial. Given the probabilistic nature of machine learning, use of our Services may, in some situations, result in Output that does not accurately reflect real people, places, or facts.

Important Notes

When you use our Services you understand and agree:

• Output may not always be accurate. You should not rely on Output from our Services as a sole source of truth or factual information, or as a substitute for professional advice.

• You must evaluate Output for accuracy and appropriateness for your use case, including using human review as appropriate, before using or sharing Output from the Services.

• You must not use any Output relating to a person for any purpose that could have a legal or material impact on that person, such as making credit, educational, employment, housing, insurance, legal, medical, or other important decisions about them.

Image generation

Subject to the Content Policy and Terms of OpenAI, you own the images you create with DALL·E, including the right to reprint, sell, and merchandise – regardless of whether an image was generated through a free or paid credit.

Important Reminder

• Ownership does not extend to prohibiting others from using the same image. The system may generate the same output for different users.
  

• The DALL·E content policy prohibits using the software to promote hate, harassment, violence, harm, create shocking imagery, sexual images, political images, deceptive or illegal images, and emphasizes respecting other people’s rights by not uploading images of people without their permission.
  

• AI-generated images are based on the data fed into the model, which could include copyrighted images. Therefore, users should think twice before sharing their content. Avoid creating images of politicians, famous people, or individuals without their consent. Refrain from creating images that may infringe on copyrights, including images of famous characters, art, cartoons, etc.

User Responsibilities

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

Communications

When you create an Account on our Service, you consent to receiving newsletters, marketing materials, promotional offers, and other relevant information from us. However, you have the option to unsubscribe from any or all of these communications by clicking the unsubscribe link provided or by contacting us directly at support@omnigpt.co.

Subscriptions

If you wish to purchase a subscription or any product or service made available through our Service, you may be asked to provide certain information relevant to your purchase, including, without limitation, your credit card number, expiration date, and billing address.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct, and complete.

We use Paddle to manage payments and complete subscriptions. By submitting your information, you grant us the right to provide the information to Paddle, subject to our Privacy Policy.

Refunds

We provide refunds for subscriptions if requested within three (3) calendar days from the date of purchase. Refunds are only issued in situations where the user is unable to properly utilize key features or functions of the Service through no fault of their own, despite good faith efforts to resolve any problems.

Users are responsible for managing and canceling subscriptions prior to renewal billing dates. Due to processing timelines, charges may still occur for cancellations made the same day as the renewal date. In those cases, we can assist with refund requests. However, users must cancel subscriptions within adequate time before scheduled renewal dates, and any refund requests received more than seven (3) days after the subscription purchase renewal date will not be eligible.

We cannot make exceptions given the automated nature of the billing and refund processes. Users are advised to carefully review subscription terms presented at the time of purchase.

Fair Usage Policy

To ensure a fair and sustainable service, we have implemented usage limits that vary based on the specific model and user type. These limits are designed to balance providing an enjoyable user experience while maintaining a sustainable business model.

• Plus users: Higher generation limits (approximately 30 messages/hour for most models)

• Free users: Basic access (approximately 15 messages/hour)

As a small startup, OmniGPT aims to make AI accessible to everyone. However, operating within thin margins can be challenging. We are continuously working on optimizing our rate limits and prices to strike a balance between providing an enjoyable user experience and maintaining a sustainable business model.

OmniGPT reserves the right to change usage limits and prices over time as we adapt to the evolving landscape. We are committed to transparency and will always communicate any changes to our policies through our social media channels, and e-mail.

Prohibited Uses

At OmniGPT, we strive to provide a safe and lawful service to our users. You agree to use our Service only for legitimate purposes and in compliance with these Terms. Specifically, you agree not to use our Service:

• In any manner that violates applicable laws or regulations, whether national or international.

• For the purpose of exploiting, harming, or attempting to exploit or harm minors by exposing them to inappropriate content or any other means.

• To transmit or facilitate the sending of unsolicited advertising, promotional materials, junk mail, chain letters, spam, or any other form of unauthorized solicitation.

• To impersonate OmniGPT, our employees, other users, or any other person or entity.

• In any way that infringes upon the rights of others, or in connection with any illegal, threatening, fraudulent, or harmful purpose or activity.

• To engage in conduct that restricts or inhibits the use or enjoyment of our Service by others, or that may harm, offend, or expose OmniGPT or our users to liability.

• To generate sexual, religious, or political content, as our AI service provider Open Router  (https://openrouter.ai/) prohibits such content generation.

Additionally, you agree not to:

• Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real time activities through Service.

• Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.

• Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent.

• Use any device, software, or routine that interferes with the proper working of Service.

• Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.

• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service, the server on which Service is stored, or any server, computer, or database connected to Service.

• Attack Service via a denial-of-service attack or a distributed denial-of-service attack.

• Take any action that may damage or falsify Company rating.

• Share your account with others or abuse the usage of OmniGPT. If multiple accounts are needed, please utilize our team feature to have all accounts under one billing.

• Otherwise attempt to interfere with the proper working of Service.

Fraud Prevention

To safeguard our service from fraudulent activities, OmniGPT reserves the right to cancel any account and subscription without refund if we detect suspicious or potentially fraudulent behavior. In cases where fraud is suspected, users may be required to provide valid proof of identity and ownership of the payment methods used to prevent misuse of our platform.

Intellectual Property

• The OmniGPT name, logo, and branding elements are the exclusive property of OmniGPT, Ltd.

• Third-party logos and trademarks (such as OpenAI, Claude, etc.) remain the property of their respective owners and are used under their public API terms of service

• Users may not use OmniGPT's proprietary branding without explicit written permission

Changes to Terms
